App Terms of Service

The agreement between you and us when you use the Arcana Origin app.

1. Who we are and what this covers

"Arcana Origin," "we," "us" and "our" mean Alex Costa, a sole proprietor doing business as Arcana Origin, 1057 Saratoga St, Boston, MA 02128, United States. These App Terms govern your use of the Arcana Origin iOS app (the "App") and everything you buy inside it. The website at arcanaorigin.com has its own Terms of Service; where you use both, each document governs its own product, and your key balance and any account you create are shared between the two under both. How the App handles your personal data is described in the App Privacy Policy, which forms part of these terms.

By downloading, installing or using the App you agree to these terms. If you do not agree, do not use the App.

2. What the app is — and is not

The App generates symbolic readings — astrology, numerology, tarot and dozens of other traditions — from the birth details you give it, with the help of an AI language model. It is offered for personal reflection, curiosity and entertainment. Its output is interpretive and symbolic. It is not a prediction, a diagnosis, a recommendation or a fact about you.

The App is not medical, mental-health, legal, financial, investment, relationship, career or safety advice, and must not be used as a substitute for any of them. Never make a decision about your health, your money, your relationships, your safety or anyone else's on the basis of a reading. If you are in distress, contact a qualified professional or your local emergency services.

3. Who may use the app

You must be at least 16 years old (or the age of digital consent where you live, if higher) and able to enter a binding contract. The App is not directed at children. If you are under 18, you confirm that a parent or guardian has agreed to these terms on your behalf and that any purchase is made with their permission.

4. Keys, packs and the shared balance

Readings cost keys. One key opens one reading, unless the App shows a different price for a specific reading before you confirm. You can get keys three ways: as a gift when you first join, in one-off key packs, or through a Seeker subscription (Section 5). Keys never expire, are non-transferable, have no cash value and cannot be exchanged for money except where a refund is due under Section 7 or the law.

Apple shows the exact price in your local currency, including any tax, before you confirm. Prices may change; a change never affects keys you already hold or the current period of a subscription you already pay for.

One balance, two doors. Keys bought in the App and credits bought on arcanaorigin.com are one balance tied to your token or account. What you buy in either place can be used in either place.

5. Seeker subscriptions

The App offers two auto-renewing subscriptions, sold through Apple:

This is a different product from "Seeker" on the website. On arcanaorigin.com, "Seeker" is a one-time $11 purchase that never renews. In the App, Seeker Monthly and Seeker Annual renew automatically. The two are not interchangeable and buying one does not give you the other.

Automatic renewal — read this part. Payment is charged to your Apple ID when you confirm the purchase. Your subscription renews automatically at the price and period shown above, and the renewal is charged to your Apple ID within 24 hours before the end of the current period, unless you cancel at least 24 hours before the current period ends. You can cancel at any time in your device's Settings → [your name] → Subscriptions, or in the App Store app under your account. Cancelling stops future renewals; you keep everything the subscription gave you until the end of the period you already paid for — for Seeker Annual that means all twelve monthly key credits of the prepaid year continue to arrive after you cancel — and every key already credited stays in your balance. Deleting the App does not cancel a subscription. We cannot cancel an Apple subscription for you.

If we change the price of a subscription, Apple will notify you in advance and, where required, ask you to agree before the new price takes effect; if you do not agree, the subscription ends at the close of your current period. Keys credited during a period are yours to keep even if you cancel.

6. Free trials and introductory offers

Where the App offers a free trial (for example, 3 days of Seeker), the trial converts to a paid subscription at the price and period shown unless you cancel at least 24 hours before the trial ends. Apple shows the trial length, the price after the trial and the renewal date before you start. One introductory offer per Apple ID. Any unused part of a free trial is forfeited when you buy a subscription.

7. Refunds, cancellation and withdrawal

Everything you buy in the App is sold by Apple as merchant of record, so Apple handles refunds. Request one at reportaproblem.apple.com or through your App Store purchase history; Apple decides under its own Media Services Terms and, where you live in the EU or UK, under the consumer-protection rules that apply to Apple there. We do not receive your payment and cannot refund an in-app purchase ourselves. The 14-day refund offered on arcanaorigin.com applies to website purchases only. Because keys bought in either place share one balance: Apple decides an in-app refund under its own rules regardless of where the keys were spent, and a website refund under the 14-day promise is decided by us and does not depend on where the keys were used.

EU / UK right of withdrawal. If you are a consumer in the European Economic Area or the United Kingdom, you have a statutory right to withdraw from a purchase of digital content within 14 days without giving a reason, subject to the rules on immediate delivery. Apple presents that right, and the way to exercise it, at the point of purchase, and honours it under its own terms. Nothing in these App Terms limits it.

Our promise on top. If a reading fails to generate after a key has been spent, the key is returned automatically. If it is not, email [email protected] and we will restore it.

8. Accounts and devices

You can use the App without an account. An optional account (email code or Sign in with Apple) lets your readings, journal and key balance follow you between devices and the website. You are responsible for keeping your device and sign-in method secure. A subscription may be limited to a small number of devices; the App will tell you if you reach that limit. You may delete your account and everything in it at any time from the App, from the account page on arcanaorigin.com, or by email; deletion is immediate and irreversible (backup copies expire within 30 days), and your key balance stays on your token.

9. Acceptable use

Use the App only for its intended purpose and only for yourself (or, if you are a practitioner, for clients you serve in person under your own responsibility). Do not: use scripts, bots or automation; scrape, copy or bulk-export readings other than through the App's own export feature; try to bypass key costs, device limits or rate limits; reverse-engineer the App or its prompts; use the App to harass, defame or make decisions about another person; submit content that is unlawful or that you have no right to submit (including someone else's photograph without their consent); or resell readings as your own service. The App applies automated abuse-prevention limits — currently 5 readings per hour per token — that exist only to stop abuse, never to ration a subscription; if you ever hit one in normal use, access resumes within the hour and it is not a breach.

10. Your content, our content, AI output

Yours. You own the birth details, photographs, journal entries and other content you put into the App. You give us a limited licence to process it only to provide the service to you, as described in the App Privacy Policy.

Ours. The App, its design, its names, artwork, texts, prompts, tradition data and code are ours or our licensors' and are protected by copyright and other laws. You receive a personal, non-transferable, revocable licence to use the App on Apple-branded devices you own or control, as Apple's usage rules allow. You may not copy, modify, distribute, sell or lease any part of it.

Readings. You may keep, print and share the readings generated for you for personal, non-commercial use. Readings are produced by an AI system and by deterministic calculations; they may contain errors, inconsistencies or content that is inappropriate for you, and we do not review them before you see them. The same input may produce different output on different days.

11. Apple-specific terms

The App is licensed, not sold, under Apple's Licensed Application End User License Agreement, and these App Terms supplement it. In addition, you and we acknowledge that:

• These terms are between you and us only, not Apple. We, not Apple, are solely responsible for the App and its content.
• Apple has no obligation to provide maintenance or support for the App.
• To the extent any warranty applies and the App fails to conform to it, you may notify Apple and Apple will refund the purchase price of the App (if any); Apple has no other warranty obligation, and any other claim, loss, liability, damage, cost or expense attributable to a failure to conform to a warranty is our responsibility, subject to Section 13.
• We, not Apple, are responsible for addressing any claim by you or a third party relating to the App or your use of it, including product-liability claims, claims that the App fails to conform to a legal or regulatory requirement, and consumer-protection or similar claims.
• If a third party claims the App infringes its intellectual property, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated a "terrorist supporting" country, and are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
• You must comply with any applicable third-party terms (for example, your wireless carrier's) when using the App.

12. No advice; no warranties

The App and every reading are provided "as is" and "as available," for reflection and entertainment only. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, non-infringement and uninterrupted or error-free operation. We do not warrant that any reading is accurate, complete, reliable, current or suitable for any purpose, that the App will meet your requirements, or that any outcome described in a reading will occur. You use the App and rely on its output entirely at your own risk.

Some jurisdictions do not allow certain warranty disclaimers, so parts of the paragraph above may not apply to you. Nothing in these terms excludes any warranty or right that cannot be excluded by law.

13. Limitation of liability

To the maximum extent permitted by law, Arcana Origin, Alex Costa and any contractors or affiliates shall not be liable for any indirect, incidental, consequential, special, exemplary or punitive damages, or for any loss of profits, revenue, savings, data, goodwill or opportunity, or for any decision made or action taken in reliance on a reading, however caused and under any theory of liability, even if advised of the possibility. To the same extent, our total aggregate liability for all claims arising out of or relating to the App or these terms shall not exceed the greater of (a) the amount you paid for in-app purchases in the twelve months before the event giving rise to the claim, or (b) fifty US dollars (US$50).

What we never exclude. Nothing in these terms limits or excludes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for anything else that cannot be limited or excluded under the law that applies to you. If you are a consumer in the EU, UK or another jurisdiction whose mandatory law gives you rights that these terms cannot reduce, those rights prevail over this Section.

14. Your responsibility for your use

To the extent permitted by the law that applies to you, you agree to compensate us for losses, costs and reasonable legal fees we incur because of a claim by a third party arising from your breach of these terms, your unlawful use of the App, or content you submitted without the right to do so. Where you are a consumer, this applies only to losses caused by your fault and only as far as your local law allows.

15. Suspension and termination

You may stop using the App at any time; delete it, and cancel any subscription in your Apple ID settings. We may suspend or terminate your access if you materially breach these terms, if the law requires it, or if we discontinue the App. If we terminate for your breach, you keep any unused keys you paid for and may still use them on arcanaorigin.com, and we will support your request to Apple for a refund of any remaining subscription period — unless the breach was fraud, chargeback abuse or automated abuse, in which case they are forfeited to the extent the law allows. If we discontinue the App, we will give reasonable notice and will support your request to Apple for a proportionate refund where the law provides for one. Sections 10, 12, 13, 14 and 16 survive termination.

16. Governing law, consumer rights and disputes

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. The UN Convention on Contracts for the International Sale of Goods does not apply.

If you are a consumer in the EU, UK, Switzerland or another country whose law protects consumers, you also benefit from the mandatory provisions of the law of the country where you live, and you may bring a claim in the courts of that country. Nothing in these terms deprives you of that protection. We are not obliged to and do not currently participate in alternative dispute-resolution proceedings before a consumer arbitration body; EU and UK consumers may contact their national consumer authority or the European Consumer Centre in their country for help with a cross-border complaint.

Talk to us first. Before starting any formal proceeding, contact [email protected] with a description of the problem; we will try to resolve it with you within 30 days. Subject to your consumer rights above, any dispute that cannot be resolved that way will be heard in the state or federal courts located in Delaware, and each party consents to their jurisdiction. Where the law allows, each party waives any right to a jury trial and agrees that claims will be brought individually and not as a class or representative action.

17. Changes to these terms

We may update these terms as the App, the law or Apple's requirements change. The "Last updated" date at the top shows the current version. For material changes we will give at least 30 days' notice in the App or by email if you have an account, and a change that reduces your rights will not apply to a subscription period you have already paid for. If you do not accept a change, stop using the App and cancel any subscription before the change takes effect.
